DUIs and Your Driver’s License Status

If you commit a DUI in Georgia, you run the risk of getting your driver’s license either revoked or suspended. This article explains the difference between these two outcomes.

  1. Revocation
  • You will lose the ability to drive “until the end of the period of time prescribed by DDS.” Once the revocation period has expired, the driver may apply for a new driver’s license, after he has satisfied “the certain requirements.”
  • Licenses are revoked generally for five years or longer.
  • Licenses are revoked for the following reasons:
  1.  Alcohol or drug addiction prohibits you from being fit to drive a vehicle.
  2. You will not be re-examined for your driving skills or knowledge of driving laws after you were reasonably requested to do so.
  3. You are declared a habitual violator, within the last five years, for a third conviction of a mandatory suspended offense.

  1. Suspension
  • You will lose the ability to drive “for a specific period of time.” Once that time has passed, and you satisfy certain requirements, you can reapply for a driver’s license.
  • Licenses are suspended for a limited time, generally not more than three years. This is the case even if notice says that the license is suspended “indefinitely.”
  • Licenses are suspended for the following reasons:
  1. Felony committed while using a vehicle.
  2. Killing someone with a vehicle.
  3. Using a vehicle to flee from a police officer.
  4. Leaving the scene of an accident.
  5. Hit and run.
  6. Racing a vehicle.
  7. Driving on a revoked, cancelled, or suspended license.
  8. Driving under the influence.
  9. Accumulating fifteen points within two years under Georgia’s point system.
  10. Driving without insurance.
