Third Time DUI Offenders

Third time DUI offenders, within a ten year period, are still charged with a misdemeanor.  This misdemeanor, however, is a “high and aggravated” misdemeanor.  Therefore, they come with steeper penalties than a regular misdemeanor:

  • Jail time of 120 days to 12 months in jail. You must serve at least 15 days in jail
  • Fine of between $1000 and $5000
  • 30 days of community service
  • Completion of Risk Reduction Program
  • Completion of substance abuse treatment
  • Probation of 12 months
  • Five years of a suspended driver’s license
  • Photo published in local newspaper as DUI offender

Many people are concerned about having their license revoked.  It is a serious matter.  After the license is taken, you will receive a temporary 30 day driving permit.  After the 30 day period, your license will be suspended for a minimum of five years.  If you meet the necessary requirements, however, you might be able to apply for a probationary license after 2 years.
